Moving Qualified Assets – Which Form Do I Use?
Moving assets between qualified retirement accounts (401(k)s, pensions, IRAs, Roth IRAs, etc.) requires additional documentation and disclosures.
In most cases, one rollover disclosure form is required when transferring funds between qualified accounts.
If funds are coming from multiple source accounts or going to multiple destination accounts, a separate form is required for each transfer combination.
Where are the funds going?
Moving to Non-Annuity Accounts
Complete ONE of the following forms:
- Qualified Plan Rollover Education
- Defined Contribution Rollover Recommendation
- Defined Benefit Rollover Recommendation
- IRA to IRA Rollover/Transfer Form
(required if the source is an IRA, SEP, SIMPLE, Traditional, Roth, or 457 plan)
No form is required when the source is a regular annual cash contribution.
Moving to Annuities
All qualified annuity transactions require:
84-24 Qualified Annuity Disclosure
Important notes:
- The 84-24 disclosure remains valid for 3 years for additional deposits.
- If the disclosure is older than 3 years, the registered representative must update it with the client.
If the source is a qualified plan and the transaction is an additional deposit to an existing annuity, one of the additional forms is also required:
- Qualified Plan Rollover Education
- Defined Contribution Rollover Recommendation
- Defined Benefit Rollover Recommendation
This is the only situation where two disclosure forms may be required.
Exceptions
The following transactions do not require these disclosures:
- Re-registering a custodial IRA for a minor to a standard IRA upon reaching the age of majority at the same vendor
- Converting a Traditional IRA to a Roth IRA at the same vendor
- Transferring a deceased account to an Inherited IRA at the same vendor
If the inherited IRA is established at a new vendor, an IRA-to-IRA disclosure is required.
Additional requirement:
- A death certificate is required when transferring assets from a deceased account into an inherited IRA (IRA BDA).
